By using Photo Spells, you agree to these terms. Please read them carefully. If you don't agree, you shouldn't use the service.
The service
Photo Spells is an AI-powered photo transformation platform. You upload photos, and our AI applies creative effects and transformations to them.
Photo Spells is a creative tool. It isn't a replacement for professional photo editing, retouching, or any regulated service. Results depend on the quality of your input and the nature of the transformation you choose. We don't guarantee specific outcomes.
Accounts
To use Photo Spells, you need to create an account with a valid email address. You're responsible for keeping your login credentials secure and for all activity that happens under your account.
You must be at least 16 years old to create an account. By signing up, you confirm that the information you provide is accurate.
Plans and pricing
Photo Spells offers three plans:
- Spark -- Free. Includes a limited number of transformations per month.
- Enchant -- $9/month. More transformations, higher resolution outputs, and priority processing.
- Arcane -- $29/month. Unlimited transformations, maximum resolution, early access to new features, and priority support.
We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified by email before any price changes take effect on their accounts.
Payments
Paid subscriptions are billed monthly through Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis.
- You can cancel your subscription at any time from your account settings.
- When you cancel, you'll keep access to paid features until the end of your current billing period.
- If you upgrade or downgrade mid-cycle, charges are prorated.
- Refunds are handled on a case-by-case basis. Contact us if you believe you've been charged in error.
Content ownership
Your photos remain yours. When you upload an image to Photo Spells, you retain full ownership and all rights to that image.
We don't claim any intellectual property rights over your original photos or the transformed results. You're free to use, share, sell, or do whatever you like with your transformed images.
By uploading content, you grant us a limited, temporary license to process your images solely for the purpose of delivering the transformation. This license expires when your files are deleted from our servers (within 24 hours of processing).
Acceptable use
You agree not to use Photo Spells to:
- Create, distribute, or promote illegal content.
- Generate deepfakes or manipulated media intended to deceive, harass, defame, or harm others.
- Produce content that exploits minors in any way.
- Infringe on the intellectual property or privacy rights of others.
- Attempt to reverse-engineer, overload, or disrupt the service.
- Circumvent usage limits or access controls.
We reserve the right to suspend or terminate accounts that violate these rules, without prior notice and without refund.
Intellectual property
The Photo Spells name, logo, website design, and underlying technology are the property of Photo Spells and its operator. You may not copy, modify, or redistribute any part of the service without written permission.
Limitation of liability
Photo Spells is provided "as is" and "as available." We don't make warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by Norwegian law:
- We aren't liable for any indirect, incidental, special, or consequential damages arising from your use of the service.
- Our total liability for any claim related to the service is limited to the amount you've paid us in the 12 months before the claim arose.
- We aren't responsible for data loss, service interruptions, or third-party actions.
Termination
You can delete your account at any time. We can also terminate or suspend your account if you violate these terms or if we discontinue the service.
Upon termination, your right to use the service ends immediately. We'll delete your personal data in accordance with our Privacy Policy.
Governing law
These terms are governed by the laws of Norway. Any disputes arising from these terms or your use of Photo Spells will be resolved in the courts of Trondheim, Norway.
